■ FREQUENTLY ASKEDQUESTIONS

Questions & Answers

UK production companies may claim reliefs such as Film Tax Relief, High-End TV Relief, Animation Tax Relief, Theatre Tax Relief, and Video Games Relief, now delivered largely through the Audio-Visual and Video Games Expenditure Credits. These reduce Corporation Tax or provide a payable credit on qualifying UK spend. The US offers separate federal and state production incentives. We assess eligibility and prepare robust claims for both.

Most UK entertainers work as self-employed sole traders or through personal companies, reporting income via Self Assessment and paying Income Tax and National Insurance, subject to IR35 where relevant. US performers report freelance income on Schedule C and pay self-employment tax. We handle mixed PAYE, freelance, and company income and identify every allowable deduction to lower your bill.

Royalties from music, film, and content are generally taxable income, and payments crossing borders can suffer withholding tax at source. The UK-US double taxation treaty often reduces or eliminates that withholding and lets you claim credit for foreign tax paid. We structure royalty and licensing arrangements and file the right treaty paperwork so global income is not taxed twice.

A UK entertainment business must register for VAT once taxable turnover exceeds the registration threshold in a rolling 12-month period, charging VAT on relevant supplies and reclaiming input VAT on costs. International sales and digital services have specific place-of-supply rules. The US applies state sales tax instead. We advise on registration and manage accurate, timely VAT returns.

IR35 off-payroll rules can apply when a performer or crew member supplies services through a personal company but is engaged like an employee. Since 2021, medium and large engagers usually determine status and deduct tax. Getting assessments and contracts right is critical. We review engagements, challenge incorrect determinations, and structure compliant arrangements to protect income.

Cross-border productions must navigate both HMRC and IRS rules, including where the entity is resident, how profits are allocated, withholding on cross-border payments, and which country grants production incentives. The US-UK tax treaty helps prevent double taxation. As dual-qualified advisers we structure co-productions and distribution deals so they remain compliant and tax-efficient on both sides of the Atlantic.
